Terms and Conditions
1. Contract
A contract between you and Giddy Up Ponies will only take place once the order has been accepted, processed and items are dispatched, at which point, your credit/debit card will be debited for the value of the goods and postage costs. Giddy Up Ponies sells to UK & International customers however, can only receive payments in pounds sterling.
2.Privacy Policy
As a customer of Giddy Up Ponies, we are committed to protecting your security and looking after the information you supply to us. Any information provided will be used to confirm and fulfil your order, deal with your queries and to send you information from time to time regarding our products and services for the purpose of keeping our records up-to-date. Should you not wish to receive communication from us, then you will be given the option of ‘opting out’ on all information sent by us and when you register on our website. On occasion, your details may be shared with our suppliers in order to fulfil your order but we will not release, offer or sell any personal information you provide to other third parties without first seeking your permission. When registering and creating an account with Giddy Up Ponies, it is your responsibility to ensure that all information provided via this website is correct and only applicable to you. It is also advised that you keep your passwords confidential to you to avoid unauthorised access.
3. Product Availability
In the event a product is out of stock, we will notify you immediately and advise you of an expected delivery date. Should this not be acceptable to you, then an alternative product will be offered or a refund given - as instructed by you. We reserve the right to withdraw or discontinue a product at any time.
4. Pricing
Giddy Up Ponies is not VAT registered but VAT is included on the products that are applicable to this tax where appropriate to English Law and this is at the current rate. All prices are in pounds sterling. We reserve the right to change prices as necessary.
5. Liability for Information
Every effort is taken to ensure that products are listed with correct features, benefits, sizes, colours and prices. Giddy Up Ponies cannot be held responsible for any variations of these and provides information with this regard as supplied to us. All product photographs are representative only and as a result, colours/styles/fonts/motifs may vary, in particular with hand-made items such as stable signs and hat covers. We reserve the right to discontinue items where necessary.
6. Copywrite & Intellectual Property Rights
Giddy Up Ponies reserve the copyright to their logo and all contents included on the website. Any images, photographs or logos included on the website remain the intellectual property of Giddy Up Ponies and as such may only be reproduced, used or displayed elsewhere with written consent of Giddy Up Ponies. In addition, we reserve the right to withdraw permission of usage for any reason, at any time.
7. Payment
By debit or credit card - we accept most major debit or credit cards. We accept online payments through a secure environment (Paypal) or telephone payments using a credit/debit card terminal (Streamline). All transactions are shown in pounds Sterling.
By cheque - made payable to Giddy Up Ponies. Please include your cheque guarantee card number on the reverse of the cheque and enclose a copy of your order.
8. Security
Debit and credit card security is provided through Paypal & Streamline.
9. Delivery of Goods
Once you have placed your order, our Standard Delivery service will be dispatched within 2 - 5 working days however, please allow up to 7 working days for delivery during busy periods ie Christmas. If your delivery is likely to take longer we will contact you. Please allow between 7 – 14 days for the delivery of stable signs, hat covers and sparkly browbands, this is due to production timescales. Postage and packing for most items on a Standard Delivery service is £4.95 for UK mainland customers. An Express Delivery option is available on orders placed before 12 noon and this is a 1 - 2 day service charged at £9.95. Please note that a signature will be required on receipt of your goods and if you are out a card will be left notifying you of the delivery attempt including details of who to contact to arrange a second delivery. Second attempt deliveries may be charged for and in cases where parcels are returned to Giddy Up Ponies there will be a £10 handling charge. Please note that they do not make timed deliveries. Giddy Up Ponies cannot be held responsible for deliveries that are not signed for. POSTAGE QUOTES - Please contact us for postage quotes if you are situated outside the UK including the Republic of Ireland, Channel Islands and Scottish Highlands. Delivery charges on some bulky or large, unusual shaped items will be priced differently and you will be notified of this when you add them to your shopping bucket.
10. Returns, Exchanges and Faulty/Damaged Items
Should you wish to return a product to us for a full refund (less postage), an exchange or because of a faulty/damaged item, please ensure the following:
The item(s) is/are returned by you in its original packaging with all tags, unused and unsoiled within 14 days of receipt.
It is your responsibility to pay for the cost of returning the item(s) to us.
Returns made after 14 days or soiled, used or minus packaging and tags will not be eligible for a refund or exchange.
Complete the Returns Form sent out with your Delivery Note and include it with your returned item(s).
Ensure your parcel is properly packaged to avoid damage.
Take your parcel to the Post Office. We recommend that you obtain proof of postage, ideally with a signature from us on delivery to ensure there is no loss or damage on return. Giddy Up Ponies will not be held responsible for any returned item that is lost or damaged.
All exchanges are to be returned as outlined above. State on the Returns Form what exchange item(s) is/are to be made ie, size, colour etc and include a cheque for £4.95 to cover the postage and packaging costs incurred to send out another item(s).
Any refund given will be minus the postage and packing fee(s) with the exception of faulty items.
All faulty or damaged items are to be returned as outlined above. State on the Returns Form what the fault is and whether you require a replacement or a refund. If a refund is requested it will be credited in full including the postage costs.
Replacement items will not be sent for exchanges or faulty/damaged goods until we have received the original returned item(s).
We do not give refunds or exchanges on items returned after 14 days.
Due to the Health and Safety regulations and hygiene problems involved in the inspection of footwear and horse clothing, it is regrettable that we are unable to inspect any item unless it is clean and dry (Health and Safety at Work Act 1974). Please take care when trying on pony rugs as we cannot accept a returned rug that is soiled after being tried on. Therefore, we suggest that rugs should be tried on over a bed sheet on the pony to ensure they remain clean. In the case of Riding Hats and/or Skull Caps, as these are a batch-tested, safety item, we regret that we cannot accept returned Riding Hats and/or Skull Caps that have been wrongly ordered. Any hats or skull caps which are faulty when first inspected will be credited after they have been returned to the manufacturer and verified at having fault.
In the case of Books, our normal terms apply as long as each book is unopened, not been read and in its original, new condition.
In the case of Jewellery, our normal terms apply with the exception of earrings. Due to hygiene regulations, these cannot be returned once purchased. Giddy Up Ponies cannot be held responsible for how customers care and clean for their jewellery once purchased. Please see 13. Jewellery for more details.
The customer returns procedure is clearly stated on the reverse of the Returns Form.
11. Returns, Exchanges and Faulty/Damaged Items for Personalised Items (eg Stable Signs / Hat Covers / Boxes, Mirrors & Frames / Sparkly Browbands)
These terms & conditions are in addition to the terms & conditions outlined above in point 10.
Any complaints or returns in the first instance are requested to telephone Giddy Up Ponies within 48 hours of receiving your personalised item. After this time no return, refund or replacement can be made.
If there is a spelling error which is our fault, then a replacement will be sent free of charge.
A refund or replacement will not be given on the basis of any naturally occurring feature of the wood/material and this includes, but is not limited to knots and woodgrain. This also includes any variation in letter depth/size as this is entirely due to the manufacturing process.
We will not guarantee or accept returns based on colour or finish unless either is faulty.
All photographs shown with regard to personalised items as listed above and on the website are representative only and as a result, colours/styles/fonts/motifs may vary, as these are hand-made to order items.
We reserve the right to remove, amend or change any of the colours or motifs offered and will not guarantee against any difference in paint/material colour from different batches or from unavailability of any colour or finish in the future. Where a colour or finish becomes obsolete an alternative is offered and customer cancellation terms apply.
After payment has been made, all cancelled orders are non-refundable due to production costs.
We do not accept returns of any personalised item that has been ordered by the customer in the wrong colour, style, design or size.
If you wish to change an order after payment has been made, then any associated costs incurred for such changes are to be paid in addition and advance.
Before any refund or replacement is given, you must return the personalised item purchased to us at your expense, for review by the manufacturer. Complete the Returns Form sent out with your order and include it with your returned personalised item. Please ensure that it is properly packaged and we recommend that you obtain proof of postage, ideally with a signature from us on delivery to ensure there is no loss or damage on return. We cannot be held responsible nor refund for returned personalised items that are lost because of being sent without proof of posting.
Refunds for items lost in the post will not be made until the completion of claims procedure with Royal Mail. Goods will be posted Royal Mail First Class recorded delivery and we shall not be held responsible for any delay caused by Royal Mail or their employees.
All returned personalised items must be received by us within 7 days of telephoning your complaint. After this time no refund can be given.
All returned personalised items remain the property of Giddy Up Ponies and may be offered for resale elsewhere.
All photograph/images of personalised items displayed on the website are used for representative purposes only as each one is individually produced and unique and as a result colours/styles/designs etc may vary.
The customer returns procedure is clearly stated on the reverse of the Returns Form.
12. Gift Vouchers
£5 and £10 gift vouchers are available to purchase online or by telephone. Orders online will need to be paid via Paypal in advance and then a unique gift voucher will be sent direct from Giddy Up Ponies to the customer. Each voucher is worth the value shown on it and is valid for 12 months from the date of issue shown on the voucher. Each voucher can only be used once for goods ordered online or by telephone from Giddy Up Ponies and no change will be given. Vouchers are not for resale or exchanged for cash. Multiple vouchers cannot be used in the same online transaction however, this is acceptable when placing a telephone order. Giddy Up Ponies reserves the right to withdraw any gift vouchers issued at any time.
To use a gift voucher - please enter the VOUCHER CODE (shown on the front of the voucher) at the Checkout, click Update Basket and the Bucket Total will be deducted £5/£10 as appropriate. If placing a telephone order, please quote the VOUCHER CODE and your order total will be deducted the voucher value and this will be shown on the receipt sent with your goods.
13. Jewellery & Hallmarking
All items comply with current Hallmarking legislation and are hallmarked if they meet the necessary weight of over 7.78 grams, most charms weigh under this so will not be hallmarked but they are stamped 925 sterling silver. We have a pdf and a hard copy of the Dealers Notice - a copy can be supplied to all customers upon request. Please note the colours of Cubic Zirconia's may vary as this is a man-made gemstone from the finest crystal. Giddy Up Ponies cannot be held responsible for how customers care and clean for their jewellery once purchased.
At Giddy Up Ponies, we want our customers to be assured that the jewelley they are purchasing from us is genuine. All 925 jewellery sold by Giddy Up Ponies is authentic and stamped 925 silver, where it is costume jewelley or not 925 silver, no hallmark with be present.
